Are two-tier programs multi-level marketing?

They have many similarities. However, in my experience the level of hype and pestering involved is often far greater in multi-level marketing.
"Multi" is Latin for "many" and it's ridiculous to suggest that a two-tier program has "many" levels. However, the law sometimes is ridiculous. I asked MLM attorney Gerald P. Nehra for an expert's answer.
