I was starting the process of listing my horse racing affiliate program (for selling an ebook) on your site, and noticed that you list several wesbites that accept U.S. accounts to wager on horses, pro sports, etc.

I like your work and website and thought I'd take the time to let you know about a conversation I had with I. Nelson Rose, an attorney considered by many to be the primo authority on online gambling. He's worked for the casinos AND the feds!

On Oct 13 last year, President Bush signed an anti-terrorism bill into law that was easily passed by both the House and the Senate.

Attached as an amendment to that bill was a piece of legislation that had been floating around for years and always nixed by Democrats. But this year, it got by. It's the legislation that makes it officially illegal for Americans to wager with out-of-U.S. casinos/sportsbooks and for financial institutions to transfer money to same from individuals.

This brought to a crushing halt my income as an affiliate of Pinnaclesports.com, who paid their affiliates a percentage of every dollar lost by people referred to Pinnacle who had an account. Worried about what did become the inevitable--Pinnacle closing down U.S. accounts entirely--I contacted Attny. Rose for his thoughts.

To cut to the chase, his opinion was that even having a banner ad on your website as an affiliate of an offshore site could, in the eyes of certain judges, be construed as aiding and abbeting a federal crime--just like the classified ads in The Sporting News that led a federal judge in St. Louis, Missouri, to hit them with a $4.1 million dollar fine last year which was upheld on appeal!

To the best of my knowledge, this hasn't happened YET to any websites linking to an offshore casino/sportsbook.

But the Sporting News didn't expect what happened to happen, either. You may wish to consider adding a message to your U.S. readers that it may not be in their best interest to join such affiliate programs listed on AffiliatePrograms.com

I regularly recieve inquiries from such offshore sites to affiliate with them through my website, [URL deleted - Moderator] (U.S.), and it's very tempting since ONE such affiliation can truly throw off enough income to live on comfortably.....but a federal judge or his/her team can find such links quite easily and the nightmare that could result isn't worth the risk, at least to me.
