I know nothing about selling sports stuff and although that isn't the main focus of this board, maybe someone here can tell me just a little.
I have a nice domain with about 30 backlinks, HuskerHoliday.com. I'd love to drop in some affiliate products and revive this site (it was a porn site after the original concept failed, I guess).
Question is, can I use the "Husker" in the domain or do I have to pay for a license from Nebraska to use even that?
I know there are all kinds of other minefields to navigate, but I suppose the most important is whether I can own/use the HuskerHoliday domain in the first place and if so, I can get educated on the rest.

I've no idea about the legal situation, however you might like to ask yourself this: even if you think you are legally in the right, what would you do if a letter arrived threatening to sue?

Oh, if it were clearly legal for me to use the name, I would use it. If not, that would be fine too.
I can't even really guess at whether it 'should' be legal or not according to the spirit of the law, as it were. I'm trying to find out of course. _________________ - blake

When it comes to something where the question as to whether it is "legal or not" and copyrights and trademarks are involved, I would recommend you find out from someone who should know ... a lawyer, preferably one who is knowledgeable about copyright and trademark law.

If you're worried, register another domain name (like nebraska-holidays.com, or nebraska-football-holidays.com or something) and redirect huskerholidays.com to the new one. You'll still get the benefit of any existing traffic, but you'll have a domain that nobody can complain about.
Alternatively, you could make HuskerHolidays.com a one-page site that has links to your other site. That way you wouldn't be too upset if you had to take it down. _________________ http://www.OneStopUnder.com - serious reading for serious photographers. |

Poolroom, that's an excellent idea. THANKS. For the meantime, I got an affiliate URL for a licensed sports merchandise site and forwarded the domain there.
BTW, I asked about it on a free legal advice board and they told me it was probably not something I wanted to do -- sell stuff under that domain.
I guess there are 'effective trademarks' even outside the realm of official trademarks.
