Post subject: dealing with TOS violation

I've got this affiliate. We will call him Bob.
Bob is in contract to not use my name or variants i list. everything else is fair game.
He blatantly uses my exact domain name.
I email and call with no avail. I call a second time. his phone is disconnected. I reduce his incentives to nil because he got those incentives while breaking a rule. don't compete with your partner.
How else do i handle it? is there somewhere i may say "hey shmoogle can you remove that? its a TOS violation for my company due to the nature of the contract i have with bob"

It seems straightforward to me. You have an affiliate agreement for a reason. He broke a business agreement. So dump him.
Many affiliates don't read affiliate agreements. Many receive far too many emails from affiliate merchants to be able to read them all. He may not know he's breaking your agreement.
However, the fact that his phone number won't work looks suspicious to me.
If he finds his affiliate links no longer work perhaps then he'll contact you and you can discuss the matter. _________________ Allan Gardyne

If you don't enforce your rules, there's no point in having them. I assume they're designed to protect your business.
Another option... You could trying writing a snail mail letter to the affiliate giving him a certain amount of time in which to start obeying the terms he agreed to when he joined your program. _________________ Allan Gardyne
