Sorry to necro this thread up,

But this W-8BEN form has some very complicated lingo on there. But from reading this thread, I guess, I can just write the bare minimum, like my name and adress and the rest is not important? Thing is, it's the first time I join CJ and what's even worst is the company I've signed up for is Canadian(Although I guess once I'm in I might as well browse the network and find others).

I just want to make sure things didn't change and I could just put up bare minimum.

I am in a similar situation: I live in Canada and wrote some books for an American publishing company. It sounds to me that this would be considered foreign sourced income. Prentice-Hall held back 30% of my royalties so I need one of the W8 forms to get it back: should I used the plain old W8?

LPR, I always put in the bare minimum and no one ever complains.

I'm based in Australia. It's the W-8BEN form that people keep asking me to use. I imagine your situation would be similar.

What do Aussies enter as their Tax ID? Is it your TFN or ABN or something else?

On the W-8BEN form - http://www.irs.gov/pub/irs-pdf/fw8ben.pdf - it says "Foreign tax identifying number, if any (optional)". I leave it blank.

When U.S. companies request it on a sign-up form, I usually write N/A, for "not applicable".

If a sign-up form refuses to work when that section is left blank, I use my ABN number, but of course a lot of affiliates won't have an ABN number.

To the best of my knowledge, there's no reason at all for a company in the U.S. to need the tax file number of an Australian affiliate.

There's also the Tax ID field inside our CJ accounts. Do you think we should we make this N/A too?

I just logged into CJ to check. It says...

Tax ID (SSN/EIN).

That's American stuff. Mine's blank. I receive my CJ commissions OK. Smile

I am presently in the midst a long round of emails with Esellerate over this W8BEN issue. I referred them to the Google Adsense page (6 times) for a definition of U.S. Activites but they just keep repeating that I have to fill out the form. I keep refusing. Around and around. They're not interested in educating themselves on this matter.

I also went through it with several other companies who backed down as soon as I explained. CJ even said they plan to put an automated form online for non-U.S. affiliates to make a declaration of non-U.S. activities (broadly meaning no equipment or employees in the U.S). Likewise with another smaller company I spoke with.

At this point Esellerate is the only hold-out I know of. Another point about this company, they have a minimum payment of $100 and if you close your account before reaching it, you forfeit the balance. As we know, Google also has a $100 minimum but if you close your account you receive your balance if it's over $10.

Esellerate came out with their new rules about the W8BEN for January 1, 2008, so if you hadn't reached the $100 minimum and been paid before then and you refuse to fill out the W8BEN you can kiss your money good-bye or prepare for a really good fight.

Hi Allan,

I am from India and I have just joined CJ. As usual, I have been asked to fill the W-8BEN form to receive my commissions. I have successfully filled in 1,2,3,4. I have filled my CJ account number in the Reference Number field (no. Cool.

I would like to know if I need to fill in Part II and III too? Also, what do I fill in the "Capacity in which acting" box in Part IV?

I am surprised you are being asked for a W8-BEN. Perhaps your circumstances are more complex.

I also belong to CJ. I wrote them an email months ago explaining that non-U.S. affiliates with no U.S. activities are not required to fill out W8-BEN's. At first I got several canned responses, but with persistence I eventually got heard by a human being. It took about 10 days but he came back with, "You're right, you don't." The requirement was taken off my account and I never heard another word about it.

I got your message but you asked me to email you something and did not give me an address to mail it to, which I wrote in a message back to you.

Actually I don't need to send you anything privately. Just go read the tax info at Google. They describe the requirements quite well. You can also look up W8-BEN requirements in the U.S. tax code online.

Thanks for the link my friend butt it didn't work out for me. I told them how it was unnecessary to submit this form and also gave the link to them but all I got was:

The link you have submitted to us is only applicable to your Google Adwords account; Unfortunately Commission Junction requires all publishers to submit their tax information. Please do not submit another incident with the same question as the answer will remain the same.

Please note: any publisher account that has not submitted tax information may be subject to a Payment Hold. If the account is placed on hold, Commission Junction will not be able to issue payment to the publisher until the hold has been removed.


So no use submitting another incident -I honestly didn't expect such a harsh tone but gotta do what they told me to.

Hi,

I agree with megatonth

This is also what I am doing... Try this one

Leave out #2 Country of incorporation or organization since you are an individual.

I put in my cj account id # for #8 Reference number

I leave out part ll as well.

So to summarise fill in :

1 , 3, 4, 8 and sign, date it, make a copy for your file and then post it.

This is how I fill my form and if you are still not clear you can read the instructions provided together with the form.

Hey everyone,

Just read through this entire thread (and scoured the internet) and it would seem like some Affiliate Networks still require filing of a W-8BEN form for non-US affiliates, even if they don't have any operations in the US.

Here is my question though... if I am from a country that does NOT have tax-treaty with the US, yet have no US operations, WILL I taxed or have my payment withheld if I file a W-8BEN?

Meaning, once I file a W-8BEN as a non-US affiliate from a country that does not have a tax treaty w/ the US, are there any taxes that still must be paid?

Or is the filing of the W-8BEN just an administrative nuisance?
