Post subject: Legal Issues with Forums
|
|
|
Hi Everyone...
For those affiliate marketers which own/manage some form of discussion forum on their sites, it would be great if you could get me upto speed with the legal issues regarding public viewpoints. If you have a disclaimer on the forums expressing something like "Comments of individual authors are their own, and are in no way associated with "your site"" is this enough to cover yourself legally?
Thanks for any advice. |

No thats not enough .
it is responsibility of webmaster to remove topics which r harmful for society .....
suppose if someone post article on your website trying to sell some illegal material and you donot delete it then offcourse you can be in big big trouble .ultimately your website is helping criminals. you can go to jail for it ... so think once again before launching forum |

I'm sure the legal issues vary where you live, but you are allowed a certain amount of freedom of speech here in the US. There are "hate" group based websites all over the place and they still exist.
Another thing the courts have decided on is some information providers can't be held liable. Take Google for an example, you can find all types of illegal thing through THEIR search. Google is aiding you in finding information on illegal activities.

That's not necessarily true in the US. You'd probably get into more trouble for a terrorist statement, but you're pretty much allowed to publish anything you want. It really depends on what you consider "helping." A criminal can use anytype of website to commit a crime. Say they want to break into a safe, and they search how they're made and function on a locksmiths website. Should that locksmith be held liable?
My guess is you won't go to jail for something posted on a forum you own if you're not encouraging it AND you're not aware of it (ie. someone posting something bad, but you don't see it and delete it until the next time you're online.) _________________ Robert
