Post subject: Newbie has question @ Licensing/Registration in New Jersey?

Hello everyone:
I have a couple of questions regarding an online business venture:
* I have a domain name already, but is it still necessary (legally) to register my business name with my state? And, if so, does anyone know what office/dept. I should register it with or can that be done online?
* What legal requirements are necessary "prior" to putting up a new website? In other words, what should be done to protect myself and my website (ie: any special forms, etc.)?
* Can anyone recommend a legitimate attorney that is willing to work online with me (in order to get my site up and running...legally)?
Any information you could offer me would be greatly appreciated. Thank you for all of your help.

It is a good idea to protect your business entity and name within your state. Usually starting out a d/b/a is common for sole proprietorships, then some form of corporation to protect personal assets when you can afford it. Most attorneys would likely recommend a corporation immediately since it will help protect personal assets from litigation involving your business.
Check you State or County web site to see what they offer and the requirements for your state.

No absolute requirements, but a "Terms of Use" "Disclaimer" and "Privacy Policy" are highly recommended.

Contact your local Bar Association to locate an attorney familiar with Internet Law.

Check out some of the online incorporation sites. Study up on the differences between Corps., S-Corps, and LLC's. You may find, as I did, that the LLC is the best of all possible worlds for a very small biz. Also look into incorporating in Nevada or Maryland due to their laws.
A dba will work for awhile, but by spending a couple hundred $$ you can gain yourself some protection. |

Hello:
Thank you for your reply. I appreciate your advice. I've been searching online for a "reputable" company that does LLC, Inc, etc, but I'm still a little skeptical. I want to make sure (being a new business owner online) that I only work with legitimate companies. There's so many decisions to make...lol. Thanks for the help.
