Non payment from affiliate network...any suggestions?

We recently signed up with another affiliate network (won't mention name yet).

We are an incentive website, and the affiliate network we joined had not dealt with incentivized sites before, but they agreed to give it a try. We were told that we would be paid for all commissions, minus any chargebacks which would only occur if the credit card use was fraudulent.

5 days into business with this affiliate network we had approx $1,300.00 in our affiliate account. We were asked to stop running the ads because the advertisers were not happy with the conversion rates. We stopped immediately, and also made it clear that we expected payment for the business we had already produced.

We heard nothing from the affiliate network for approx 2 weeks, when logging into our accont we noticed that the commissions had been reversed, and marked as "affiliate fraud".

My take on this is that if they didn't want us in, they could have told us "no" from the beginning, and that would have been the end of it. Since they allowed us in, they need to pay what is owed.

What is an "incentive website"? I tried to read your About page and your FAQ, but it wasn't very clear exactly how it works.

Being an incentive website means that we reward our members for certain actions.

For example. If they sign up for an AOL trial they get 250 points, Matchmaker 50 points, etc... They can then redeem the points they earn for various gifts.

The biggest problem with incentive sites is that visitors are induced into taking the action as opposed to taking the action on their own because they are, in fact, interested.

Conversions because of this can be great for the incentive site, but not too good for the merchant. If you have an agreement, in writing, with the network that spells out the "incentive" part as you described, you could take legal action. Heck, you can take legal action anyway but if they have legal terms that mention 'fraud, chargeback' or other generic terms you may have a hard time proving anything. Generic terms are kept that way on purpose, so they have more options to reverse.

The best thing is talk with an attorney, let them review the documents you do have, and account information available, and advise you on a course of action.

All depends on your agreement when you signed up. Do they allow incentive traffic? Did you clearly indicate your leads are incentive based?

There is value to incentive traffic, just usually LESS value. That's why some merchants get upset if they get flooded with incentive leads when they thought they were paying for "real" leads (for lack of a better term).
