Hello All,

I'm about halfway thru building my website and was wondering if I need to have the "Privacy Policy" and/or "Terms of Service" since I'm an affiliate website and if so can I copy someone else's terms of service or privacy policy(legally) and of course change everything to my website name and my policies? My thoughts are I need a privacy policy as there is a spot to collect email addresses and first and last names but since I'm an affiliate I don't think I need "Terms of Service".

Any advice helpful.

The answer to your question is Maybe.

Some affiliates do in fact require a Privacy Policy to be posted. I am not aware of any that also require a TOS. You can combine them into a single document.

And your Privacy Policy can be as simple as:

"We do not collect ANY information on our visitors"

to a full blown legal statement.

The easy way to get a simple Privacy Policy is to visit "Open Source" Software sites. When you download the open source software there is typically a "generic" privacy policy you can modify.

There is no legal problem with "borrowing" from that type of prewritten generic policy.

The reality of the Privacy Policy is it's just words on the screen. Almost nobody ever takes the time to read them.

What is more annoying is when you do read them and they are displayed in a little tiny box that would take an hour of scrolling to read.

But Affiliate Marketing is a business, and as such it's your legal responsibility to know what you are getting yourself into. Nobody can do that for you.
