Post subject: Domain, trademarks... high school student and Microsoft...

Hi everybody,
I know there are many posts and discussions regarding domain names, trademarks and copyright infringements.
Here is a very interesting article in my neck of the woods involving a high school student and Microsoft. Yes Microsoft
I thought this might make an interesting discussion and information topic on choosing creative domain names.
Here's the story...

Interesting... and sad
Larry, at first glance I would have seid the link was a disguised affiliate ilnk. IMO, "easy" is too generic a word to trademark on it's own. My guess is they got lots of email saying "where's EasyJet on your site, etc." just like our deleted toll-free #'s in the USA often get so many misdials that spammers buy them and run adult *** lines---one customer out of 1,000 misdials and they make $ sadly....

Never thought about it being an affiliate link, could be I suppose. Stelios is a pretty savvy geezer, he may have trademarked "easy"
The phone *** thing is interesting, if that is Stelios's game it would be ***?
All the best,

Some might have already heard how this all ended up. What a traffic generator. Can't buy this kind of traffic.
With all the worldwide media attention there were 250,000 attempts in 12 hours to access his Web site.
Anyhow it's all settled now...

Hello Larry.
Goodness knows how I missed this thread, but better late than never...

That's an amusing story. I like the name of Smart & Biggar, Microsoft's Canadian lawyers |
Seriously, history has shown (though I've forgotten all of them) that quite a few companies have grwon just by picking good companies as customers. It makes sense, that if a company grows it's suppliers will need to grow, too.
It reminds me of an interesting story, the truth of which I cannot confirm...
A man was driving back from a ski resort (somewhere in America), when he came across a car that had run off the road...
He stopped, and was surprised to find it was Bill Gates. He towed him back onto the road, Bill said thanks and that was that.
A few days later, the man received a phone call from his bank manager asking him to come in and see him. The man was slightly concerned, but duly turned up.
The bank manager told him that his mortgage had been paid off and a substantial sum had been deposited in his account (I can't remeber the numbers, but it ended in a few 0s.)
And all from a vehicle number ("license") plate. Amazing.
The moral of the story is, if you are driving past a Queensland beach and you come across an old Mitsubishi Magna stuck in the sand, make sure you stop and help. You just never know...
I once read about a man called Mr Virgin who ran a one van business (maybe a plumber?) in the North East of England. He had been trading as Virgin (whatever) for years before Richard Branson was in business.
Yet he was allegedly forced to change his long standing business name by a rather heavy letter from RB's lawyers - "AlmostAsSmart & PrettyBigToo".
Seems more than a little unfair, if you ask me. Surely there was absolutely no chance of confusion in this case.
Cheers,
Charlie. _________________ "Before I speak, I have something important to say."

There's a difference between being in the right, and having the financial resources to survive a long, expensive, drawn-out court case to prove it. Most people in similar situations are better off just taking the out-of-court settlement and changing their business name. _________________ http://www.OneStopUnder.com - serious reading for serious photographers. |

So, there are virgins in the North East of England ! I've just looked in my local phone book, confirmed my suspicions, there are none round here!

Very true, but in this case, I've a feeling that the "out of court settlement" was more along the lines of "do it or else" than "please accept this bribe".

Richard's changing things though... allegedly.

I'm not sure that's conclusive... ex-directory sounds very plausible to me.
